House with a crack – Hidden assets in cases of separation and divorce

Whitepaper 2026

Executive Summary

  • The key forensic question: What assets exist, to whom are they economically attributable, and what was their value on the relevant reporting dates?
  • Completeness before evaluation: In cases of separation and divorce, the completeness of asset information is the primary deciding factor – companies, holdings, real estate, securities, receivables and digital assets.
  • Crypto: fast-moving, permanently visible: Digital assets move quickly between wallets, blockchains and service providers – but public blockchains leave permanently traceable transaction traces.
  • OSINT complements blockchain analysis: Indications of shareholdings, management activities, foreign subsidiaries, domains, digital business models and real estate connections.
  • Reliable investigative approaches instead of promises: The aim is structured identification and documentation – as a basis for requests for information and supporting documents from the lawyer.
Guiding principle

Assets can be concealed or transferred. However, digital and financial traces are often more difficult to erase than the underlying asset declarations.

02 Background and relevance

In 2024, in Germany 129,337 marriages dissolved. The average duration of marriage until divorce was 14.7 years; in 65,723 divorces, minor children were affected – not a marginal issue, but a permanently relevant area of private property disputes.

In parallel, cryptocurrencies have reached a significant portion of the population: According to Bitkom (2025), 8 % of respondents aged 16 and over Four others have already bought cryptocurrencies, another four are definitely planning to do so, and 14 can imagine doing so. The most relevant group is those who acquired crypto at some point – regardless of whether they are still actively trading it today.

Scenario – no measured divorce statistics

If we apply the crypto usage rate not as a fact, but merely as a scenario to 129,337 divorces, 5 % would correspond to approximately 6,467 cases, 8 % to approximately 10,347 cases, and 10 % to approximately 12,934 cases per year. This calculation shows orders of magnitude, not the actual number of divorces involving crypto.

03 Legal framework of the equalization of accrued gains

In a community of accrued gains, the assets of the spouses generally remain separate; upon termination of the marital property regime, the gains accrued during the marriage are compared. This calculation requires that the initial and final assets, as well as any relevant decreases in assets, be fully and transparently recorded.

Two wedding rings on a cracked stone
Separate paths, shared assets. Everything that was built up during the marriage must be fully recorded – including what is not included in the list.

3.1 Information and supporting documents

Section 1379 of the German Civil Code (BGB) allows, under the conditions specified therein, information about the assets at the time of separation as well as about the assets relevant for the initial and final assets; supporting documents must be submitted upon request. Forensically documented irregularities and contradictions help lawyers to formulate specific requests for information and supporting documents.

3.2 Decreases in assets

According to Section 1375 of the German Civil Code (BGB), certain reductions in assets can be added to the final assets. Therefore, forensically relevant are not only existing assets, but also unusual outflows, transfers, and asset shifts occurring in the period surrounding separation and divorce.

3.3 Valuation on the cut-off date

The existence and value of an asset at the relevant time must be considered separately. Especially with volatile cryptocurrencies, a historical reconstruction is necessary: Which assets existed, in what quantity, and at what verifiable market value?

Important

Finanz Forensik does not replace legal advice. The forensic task consists of the technical and economic reconstruction as well as the comprehensible documentation of findings and investigative approaches.

04 Why cryptocurrencies are a special asset

The Federal Fiscal Court has ruled on virtual currencies (currency) TokenDigital assets are classified as economic goods (Judgment of 14 February 2023, IX R 3/22). Therefore, digital assets are economically assessable items – the practical difficulty usually lies in their classification and reconstruction.

4.1 Public Blockchain, Unknown Person

A wallet address typically doesn't contain a real name, but the transactions are permanently visible on many public blockchains. The central point of contention: The transaction is visible, but the economic attribution to a person must be reliably established.

  • Known wallet addresses and transaction IDs can serve as entry points.
  • Payment flows between wallets can be reconstructed in terms of time and quantity.
  • Swaps, bridges and switching between different assets can complicate analysis, but not necessarily make it impossible.
  • Inflows to centralized service providers can provide important investigative leads.
  • A technical connection is not automatically proof of ownership; attribution must be assessed separately.

4.2 Regulated Crypto Service Providers

Regulation (EU) 2023/1113 governs information obligations for cryptocurrency asset transfers via cryptocurrency service providers. This data is not freely accessible to private forensic investigators – however, blockchain analysis can document that a flow of assets leads to a specific service provider. This may provide a concrete basis for legal or regulatory action.

05 Early crypto investments as a hidden wealth potential

Recent purchases aren't the only factor to consider: it's equally important whether either spouse acquired cryptocurrencies at some point in the past. Early purchases can have a completely different economic value today due to long-term price fluctuations.

The crucial question

Not just: "Does your spouse own cryptocurrencies today?" but: "Has your spouse ever bought, transferred, stored, or worked with crypto exchanges?"„

Illustrative example: 10 BTC at €500 per Bitcoin represented an investment of €5,000. At a later price of €70,000 per BTC, the same 10 BTC would be worth €700,000 – assuming they still exist. This is not a statement about typical returns or current prices, but rather an indication of the potential leverage of long-term price appreciation.

An early purchase doesn't prove the existence of assets today: assets may have been sold, lost, gifted, or transferred to other wallets. This is precisely why reconstruction is relevant – old bank transfers, emails, wallet addresses, tax documents, or stock market accounts provide entry points for further transaction paths.

06 OSINT outside the crypto space

Wealth disclosure is significantly broader than blockchain analysis. OSINT systematically combines publicly available traces of a person and their economic environment – with a clear distinction between proven fact, verifiable evidence, and mere assumption.

Asset areaPossible OSINT/forensic approaches
Companies and investmentsCommercial register, company register, annual financial statements, managing director and shareholder remuneration, affiliated companies
Property informationPublic business and address information, companies with a real estate purpose, published transactions; land registry data only with legally permissible access.
Foreign connectionsforeign company registers, economic connections, branches, publicly accessible registers and publications
Digital business modelsDomains, websites, online shops, platform profiles, historical websites, payment and contact information
Value and lifestyle indicatorsPublicly documented high-value vehicles, boats, trips or other asset indicators – only as a starting point, not as proof of wealth
Receivables and loanspublicly recognizable business relationships, company documents, court decisions or other indications of receivables
Crypto referencesExchanges, wallet apps, hardware wallets, transaction notes, tax documents, payment flows to crypto service providers

6.1 Lifestyle and declared wealth

A noticeable discrepancy between declared income or assets and publicly visible lifestyle can be a starting point for investigation – but it is not proof of hidden wealth. Professional OSINT work identifies such observations as an indication and corroborates them with further sources.

07 Methodology of asset disclosure

A three-stage model is recommended for structured processing.

12 3 Asset screening Blockchain andTransactional analysis Forensicdocumentation
Figure 1: Three-stage model of asset disclosure. Own illustration.
1. Asset screening
Personal, company and registry research; collection of known accounts, stock exchanges, wallets, domains, companies, shareholdings and other economic reference points.
2 · Blockchain and transaction analysis
Reconstruction of known wallets and transactions, examination of redirects, swaps, bridges, exchange and service provider connections, as well as historical inventory and value analysis.
3. Forensic documentation
Separation of facts, evidence and assumptions; transparent sources; traceable transaction chains; concrete open questions and investigative approaches for lawyers or authorities.

08 How well do you really know your spouse's assets?

The questions are deliberately pointed. They are not intended to create suspicion, but rather to reveal gaps in memory and potential avenues for investigation. A "yes" answer does not mean that assets were concealed – only that a more thorough examination might be advisable.

Provocative guiding question

Are you sure you are only separating from your spouse – and not from assets whose existence you are unaware of?

Cryptocurrencies and digital assets
  • Has your spouse ever purchased Bitcoin, Ethereum, or other cryptocurrencies?
  • Do you remember statements like "I bought a little Bitcoin" or "I'm going to try crypto"?
  • Do you know what happened to these cryptocurrencies?
  • Were the coins actually sold – or merely transferred to other wallets?
  • Do you know all the cryptocurrency exchanges your spouse has used?
  • Were there accounts at Coinbase, Binance, Kraken, Crypto.com or other providers?
  • Has your spouse ever used a hardware wallet like Ledger, Do you own a Trezor or BitBox?
  • Have you seen any wallet apps, seed phrases, QR codes, or crypto screenshots?
  • Were there any transfers to cryptocurrency exchanges or payment service providers that you couldn't categorize?
  • Are there any old emails, tax documents, or invoices related to crypto?
  • Has your spouse Staking, Have you talked about DeFi, mining, trading, NFTs or stablecoins?
  • If you invested several thousand euros in Bitcoin ten or fifteen years ago: Do you know what that investment would be worth today – and whether it still exists?
Companies, investments and other assets
  • Do you actually know all of your spouse's companies and investments?
  • Are there any companies where your spouse is or was a managing director or shareholder?
  • Are there holding companies, foreign companies, or investments through third parties?
  • Are you familiar with all the properties or real estate investments?
  • Are there any holiday properties, plots of land or investments abroad?
  • Do you know if your spouse has made private loans or has claims against companies or individuals?
  • Are there any high-quality vehicles, classic cars, boats, watches, art, or other valuable items?
  • Are there any domains, online shops, digital business models, or revenue streams that you are only vaguely aware of?
  • Are you familiar with all broker accounts, payment service providers, and foreign financial relationships?
  • Do the known lifestyle and the officially declared income plausibly match?
Time of separation and asset transfers
  • Were large sums of money transferred or withdrawn shortly before or after the separation?
  • Have your bank balances, investment accounts, or crypto holdings decreased noticeably?
  • Were assets transferred to family members, business partners, or companies?
  • Were there any conspicuous sales or transfers without any verifiable equivalent value?
  • Are assets that were demonstrably present in the past no longer included in the current statement?
  • Can you explain how the assets have developed overall during the marriage?

09 Fictional case study

The following example serves solely to illustrate a possible logic of investigation.

elementExample
Initial situationMarriage since 2012, separation in 2025. Stated total assets of one spouse: EUR 420,000.
Memories of the other spousePrevious Bitcoin purchases, multiple companies, use of a Crypto exchange, indications of real estate investments.
OSINT findingsTwo company holdings, previous management experience, economic connection to another company.
Blockchain EntryA well-known historical transaction from a cryptocurrency exchange to a wallet.
analysisRedirects via multiple wallets, asset swaps, and subsequent inflow to a centralized crypto service provider.
EvaluationThe technical analysis documents a possible asset trajectory and any open allocation questions. The legal assessment and further information gathering will be carried out by the appointed attorney.

10 Limits, evidentiary value and cooperation with lawyers

Reputable asset disclosure defines its limits. OSINT and blockchain forensics document clues, connections, and transaction chains – they do not replace official disclosure rights or judicial evaluation of evidence.

  • Bank accounts cannot be fully queried centrally solely through private OSINT research.
  • Land registry information is not generally freely accessible; legal requirements for access must be observed.
  • A wallet address cannot be automatically assigned to a specific person without additional evidence.
  • Private forensic investigators cannot compel the release of customer data from regulated cryptocurrency exchanges.
  • A conspicuous lifestyle is no proof of hidden wealth.
  • BlockchainCluster and service provider assignments must be documented with their respective evidentiary value.
  • Forensic findings should be formulated in such a way that facts, evidence, and hypotheses remain clearly separated.
Cooperation

The strongest constellation is the division of labor: lawyer for legal strategy, information and procedural issues; Financial forensics for technical, economic and digital reconstruction.

11 Recommendations for action

  1. Secure all known clues early on: bank statements, emails, wallet addresses, screenshots, tax documents, stock exchange names and company references.
  2. Don't just ask about current assets, but also about historical investments and assets that were previously held.
  3. Document key dates: separation, divorce petition, unusual transfers, and known investments.
  4. OSINT and blockchain analysis converge when economic and digital traces merge.
  5. To process forensic findings in such a way that a lawyer can derive concrete further approaches to obtaining information, evidence, or investigations from them.
  6. Do not make any hasty claims of ownership. Attribution, possession, control, and economic entitlement must be assessed separately.
Final thought

The quality of an equalization of accrued gains depends significantly on the quality of the asset information. In an increasingly digital world of wealth management, it is therefore often no longer sufficient to simply look at account balances and submitted statements.
